Terms of Service

1. Acceptance of Terms

By creating an account or using NopeMode ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of the Service

NopeMode is a screen time management service that allows users to set policies for application and website usage on their devices. The Service includes:

  • A web dashboard for configuring policies and viewing usage reports
  • Client software for Windows and Android that enforces policies
  • Tamper protection features to prevent unauthorized removal or circumvention
  • Optional content filtering capabilities

3. Account Registration

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to create an account. If you are using NopeMode to manage a child's device, you represent that you are the child's parent or legal guardian.

4. Subscriptions & Payments

4.1 Subscription Tiers

NopeMode offers multiple subscription tiers with different feature sets and device limits. Current pricing and features are displayed on our website and may change with notice.

4.2 Payment Processing

All payments are processed by Paddle, our merchant of record. By subscribing, you also agree to Paddle's Terms of Service. Paddle handles invoicing, tax collection, and payment disputes.

4.3 Cancellation

You may cancel your subscription at any time through your account settings or through Paddle. Upon cancellation, your subscription remains active until the end of the current billing period. After that, your account reverts to limited functionality.

4.4 Right of Withdrawal

If you are a consumer in the EU/EEA, you have the right to withdraw from your purchase within 14 days without giving a reason, in accordance with the EU Consumer Rights Directive.

By subscribing and beginning to use the Service during the withdrawal period, you acknowledge that you may lose the right of withdrawal once the Service has been fully performed (Art. 16(a) of the Consumer Rights Directive).

To exercise your right of withdrawal, contact us at info@nopemode.com within 14 days of your purchase. Other refund requests outside the statutory withdrawal period are handled on a case-by-case basis.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Install NopeMode on devices you do not own or have authorization to manage
  • Attempt to reverse engineer, decompile, or circumvent the Service's security measures
  • Use the Service to harass, stalk, or monitor individuals without their knowledge and consent (except for minors under your legal guardianship)
  • Resell, redistribute, or sublicense the Service without our written permission
  • Interfere with or disrupt the Service's infrastructure

6. Tamper Protection

NopeMode includes tamper protection features designed to prevent unauthorized removal or circumvention. These features are a core part of the Service and exist to maintain the effectiveness of the policies you configure.

Uninstallation requires authentication with your NopeMode admin code. If you lose access to your account and admin code, contact our support team for assistance.

7. Software & Updates

The NopeMode client software may automatically download and install updates to ensure continued functionality, security, and compatibility. By using the Service, you consent to these automatic updates.

The client software includes a kernel-level driver on Windows for tamper protection and content filtering. This driver operates with elevated system privileges as required for its functionality.

8. Intellectual Property

The Service, including all software, designs, and content, is owned by NopeMode and protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

9. Limitation of Liability

To the maximum extent permitted by law, NopeMode and its operators shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages arising from your use of the Service
  • Loss of data, productivity, or profits related to use of the Service
  • Any failure of the Service to block or restrict content or applications
  • System instability or issues caused by the kernel driver component

The Service is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that all content will be successfully filtered.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your statutory consumer rights.

10. Account Termination

You may delete your account at any time through your account settings. Upon deletion, all your data will be permanently removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on our website or sending you an email. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Czech Republic. Any disputes shall be resolved by the competent courts of the Czech Republic.

If you are a consumer residing in the EU/EEA, you also retain the protection of any mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your country of residence.
